verbal opinion only ! Just bullshxt ! no legal responsibility ! Should be PCCW responsibility. The metal grating services cover with PCCW marking clearly seen (grating cover are supply & install by PCCW piror to the brick laying sub-contractor of the main contractor ie. public works dpt.) and irregarding the workmanship of the brick paving sub-constractor. The main point is that due to the nature of the grating cover design which may easily causing such possible fault resulting endanger to any people walk by.......

Of course you need to study the works contract! Architect / Engineer Specification, drawings, method statement before making the jude....

Under the building works contract if no(DLP) included in the clause! The Imply Warranty under the basic law will cover the DLP function!

in Perfect sense the main contractor are responsible for all defects found during DLP(defects liability period), but not necessary in this case if public works provide all information that at the time they inspect the works and issue instruction for completion which means they are not liable for this latent defects (need to check the time???????), so dig deep to the root (course of the defect is the grating)! The grating is PCCW properity and PCCW have the obligation to make good the defects!   my personal opinion only     

In Practice (B20 HK c-hing is right in common sense) The Client (Public works Dpt. or Road Dpt.) receive the complaint and examine the courses and instruct the party or parties involved to make good the defect works at their expense)
