1）由於你講既情況並不導致建築物有即時危險，屋宇署及警方不會受理
2）你第一件事而又最重要的是影相，將所有受破壞的地方都拍照紀錄，呢個係好重要的證據
3）上層業主有責任賠償你的選失，理論上你上層業主的判頭理應有買第三者保險，如果上層業主採取不合作態度，你有權另外找人修理然后向上層業主追討

not recommended, the cost of going to lawyer is already more than the amoung u claim,
i suggest u to go to small claimes tribunal directly

in fact u may also need a surveyor's report to support your claim
