MR XXX now has or may hereafter have with respect to the following facts or circumstances: claims arising from MR XXXX' ownership of a (Qty 1) IPHONE 3G 16GB WHITE, Serial Number 123456789 ("Original Product").

2.        Terms of Settlement: Upon MR XXXXX's execution and return of the original of this Agreement to Apple, no later than fifteen (15) days after receipt of this Agreement from Apple, this Agreement shall become effective on the following terms and conditions:

(a) Apple shall provide MR XXXX the following, at the shipping address specified by MR XXXXX: (Qty 1) IPHONE 4 BLACK 32GB-ITP, model number MC605ZP/A (hereinafter referred to as "Replacement Product"), for the previously agreed upon upgrade charge of HK$ 900, which sum is acknowledged by MR XXXXXX to be the fair charge to upgrade from the Original Product to the Replacement Product.
